All motorcycle rentals are subject to the following terms and conditions:

- We reserve the right to refuse rental to any individual at our sole discretion -

Reservations

As demand is high during the summer months (June, July and August in particular), we recommend that you make your booking as far in advance as possible to avoid disappointment.

Reservations can be made only via email at info@primomoto.com

Motorcycle Guarantee

Once we have confirmed your booking, we will guarantee you the motorcycle that you have selected. Should there be a change due to unforeseen circumstances we will advise you in advance so that you may select another motorcycle or make alternative arrangements.

Rental Day

A rental day is defined as 24 hours as opposed to calendar days. For example if you pick up the motorcycle at 3:00pm on Thursday & return it by 3:00pm on Saturday your rental period is 2 days.

Deposit & Payments

A $100 deposit is required to confirm a booking (except until April 2010). This is payable by credit card. The balance is required at the time of commencement of the rental.

All charges will be made in Canadian Dollars. If payment is made by credit card, your credit card provider will convert this to your local currency at the rates determined by them.

Cancellations & Refunds

If you cancel the booking more than 14 days in advance of the commencement of the rental, we will refund the deposit in full. If the cancellation is within 14 days of the commencement of the hire, the deposit is non-refundable. If you do not turn up for the hire (a "no show") we will keep the deposit.

If during the rental period, you return the motorcycle voluntarily earlier than the intended return date no refund on unused days is applicable.

Insurance

Comprehensive accident insurance is provided as part of the rental rate. This covers damage to the motorcycle and any third party, such as another vehicle you collide with, as well as theft and fire. Medical insurance for you the rider is not included. In Quebec road accidents are covered by the government. This covers hospital and other medical costs arising from injuries sustained in a road accident, but does NOT cover other consequential costs. We recommend that you arrange comprehensive travel insurance to cover these potential extras.

In the event of an accident you are liable for the first $3,000 which represents our insurance excess payable on any claims.

Please note that insurance is null and void if the rider has a blood/alcohol content in excess of the legal limits. Insurance does NOT cover any accessories hired with the motorcycle.

Insurance Bond

An insurance bond of $3,000 is required at the time of pick up. The bond is payable by credit card and will be refunded at the end of the rental provided that the motorcycle is returned in the same condition as it was at the commencement of the rental and with a full tank of fuel.

Driver Licence

A valid licence is required that is suitable for the type and capacity of motorcycle you are renting. This must be produced at the time of pick up, be valid within Quebec, and carried with you at all times when riding. National drivers licences, which are not in English, need to be presented in conjunction with an official translation or valid international drivers licence.

Additional Drivers

No other driver other than the approved renter is allowed to operate the motorcycle.

Minimum Age

Riders (both driver and pillion passenger where applicable) must be at least 18 years of age. We are unable, to hire motorycles to anyone under 18 at time of rental. All riders must have prior motorcycle riding experience.

Helmets & Riding Gear

Helmets for both rider and passenger are compulsory in Canada. We have a limited range of helmets, riding gear and other accessories that can be hired by phone.

Accident Insurance

In Quebec road accidents are covered by government SAAQ. This covers hospital and other medical costs arising from injuries sustained in a road accident, but does NOT cover other consequential costs.

Travel Insurance

In order to protect yourself against costs arising from an accident or other incident, that are not already covered by the Motorcycle insurance or SAAQ, we recommend that you arrange comprehensive travel insurance to cover these costs.

Road Safety and Compliance with Canadian Road Laws

It is a condition of hire that all riders agree to ride in a safe and considerate manner and to abide by Canadian road laws at all times, including the observance of speed limits and parking restrictions.

Responsability & Liability

Primomoto does not assume responsibility for any bodily injury, damage to or loss or personal effects arising from the hire. Primomoto's responsibility is limited to the supply of a motorcycle that is in good working order, is suitable for the purposes intended, and is compliant with legal requirements including current registration and certificate of fitness. It is not responsible for any delays, consequential loss, weather, acts of god, terrorism or other factors beyond its control.

Primomoto is not responsible or liable for any infringements incurred by the rider, including speeding, parking or other traffic infringements. Primomoto will require a home address for the forwarding of any traffic or other infringement notices received after the finish of the hire. Primomoto reserves the right to debit the client's credit card for any fines that are received after the completion of the hire.

Rule of Law

The hire contract entered into between Primomoto and the hirer shall be subject to the laws of the Province of Quebec (Canada).
Motorcycle Insurance Explained Standard Excess

1. For peace of mind you are automatically covered, as part of the daily hire charge, with comprehensive insurance cover which protects the bike you hire and any third party property damage which you may incur.

2. The standard excess or deductible, which means the initial amount you must pay before the insurance cover starts to apply, of $3,000.00 applies in the event of any damage to either the motorcycle or third party property.

3. How this practically happens is that a security bond of $3,000.00 is taken on the signing of the rental agreement by way of a signed credit card voucher which is held unprocessed pending the return of the bike undamaged.

4. If the motorcycle, accessories or any third party property has suffered damage or loss we will make an assessment of the monetary value of such damage or loss and, under advice to you, will deduct this value from the security bond held.

5. Therefore your maximum liability for any damage caused by you to the motorcycle, any accessories or to someone else's property is capped at $3,000.00

The security bond is also taken to cover minor items such as damage to or loss of cellphones, bike locks, keys & any top-up fuel where the motorcycle is returned with less than a full tank. Our experience has been that damage to motorcycles typically occurs where the bike is dropped and a mirror, footpeg or indicator breaks. Instances of those have been luckily minimal with us but we do emphasise your liability in respect of this bond when you hire from Primomoto.

WARNING: Insurance cover is voided, and the hirer is fully liable for all costs, if:

1. Any of the terms of the rental agreement are breached

2. Damage to property is caused by careless, willful or reckless driving including whilst the rider is under the influence of alcohol or drugs

3. Damage to property is caused by submersion in water, such as river crossing, including salt water, resulting from rider negligence

4. Damage to property is caused by riding off formed roads (eg cross country) or on roads which are not public or legal roads

5. The rider’s license is invalid, not current or not appropriately rated for the motorcycle

6. The motorcycle was not locked overnight

7. The motorcycle was being ridden in an unlawful manner.
